ACCESSIBILITY POLICY

1. COMMITMENT AND APPLICABLE STANDARD

San Diego Marketing Pros (“SDMP,” “we,” “us,” or “our”) is committed to ensuring that sdmarketingpros.com (the “Site”) is accessible to the widest possible audience, including individuals with disabilities. We are actively taking steps and devoting resources to further enhance the accessibility of our Site to meet or exceed applicable standards.

We are actively working toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, published by the World Wide Web Consortium (W3C). WCAG 2.1 Level AA is the operative standard recognized by federal courts, the U.S. Department of Justice, and the State of California for evaluating the accessibility of commercial websites. We are also mindful of the requirements of:

– Title III of the Americans with Disabilities Act (ADA)
– Section 508 of the Rehabilitation Act of 1973 (as amended)
– The California Unruh Civil Rights Act (California Civil Code Section 51)

Referencing these standards in this policy is a declaration of awareness and good-faith effort. It does not constitute a legal guarantee of full compliance at all times across all areas of the Site.


2. PARTIAL COMPLIANCE AND KNOWN LIMITATIONS

The Site is currently in a state of partial conformance with WCAG 2.1 Level AA. “Partial conformance” means that some areas of the Site do not yet fully conform, for the following reasons:

– The Site is built on WordPress with third-party plugins and page builder tools, some of which produce HTML structures that may not fully conform to WCAG guidelines and are outside our direct code-level control.
– Some images and media assets uploaded prior to adoption of this policy may lack descriptive alt text or captions. We are actively auditing and correcting these.
– Embedded video content may not yet include synchronized closed captions or transcripts.
– Certain third-party widgets, embedded scripts, and integrated tools (including analytics, advertising, and form platforms) have their own codebases that we do not directly control.
– PDF documents and downloadable files produced before the adoption of this policy may not be fully optimized for screen readers.

We are prioritizing remediation of known barriers and will update this section as issues are resolved. The listing of known limitations here is a transparency measure and does not constitute an admission of any specific legal violation.


3. ACCESSIBILITY FEATURES CURRENTLY IMPLEMENTED

We have implemented or are actively implementing the following features to support accessible use of the Site:

– Descriptive alt text for meaningful images
– Semantic heading structure (H1, H2, H3) to support screen reader navigation
– Descriptive page titles on each page
– Keyboard-navigable menus and interactive elements
– Color contrast ratios at or approaching the WCAG 4.5:1 minimum for normal text
– Form fields with associated labels for screen reader compatibility
– Descriptive link anchor text (avoiding context-free labels such as “click here”)
– No use of content that flashes more than three times per second
– Resizable text without loss of content or functionality
– ARIA landmark roles on primary page regions where supported


4. ASSISTIVE TECHNOLOGY COMPATIBILITY

The Site is designed to be compatible with the following assistive technologies when used with a current browser version:

– JAWS (screen reader, Windows)
– NVDA (screen reader, Windows)
– VoiceOver (screen reader, macOS and iOS)
– TalkBack (screen reader, Android)
– Browser-based zoom and text resizing
– Keyboard-only navigation
– High-contrast display modes

We recommend using an up-to-date version of Google Chrome, Mozilla Firefox, Apple Safari, or Microsoft Edge for the best accessible experience.


5. THIRD-PARTY CONTENT AND INTEGRATIONS

The Site incorporates third-party tools, platforms, and embedded content over which we do not exercise direct codebase control. These include but are not limited to contact forms, analytics scripts, advertising pixels, embedded maps, video players, and social media integrations. The accessibility of these third-party components is governed by those vendors and is not within our ability to guarantee or remediate directly.

We are not responsible for inaccessible content, features, or barriers originating from third-party tools or linked external websites. We encourage the vendors we work with to maintain accessible products and will evaluate accessibility as a factor when selecting and retaining third-party integrations.

The inclusion of third-party tools does not expand the scope of accessibility obligations or representations made in this policy.


6. NO WARRANTIES; “AS-IS” ACCESSIBILITY DISCLAIMER

While we are committed to continuous accessibility improvement, digital accessibility on a dynamic, actively maintained website is an ongoing process and not a fixed end-state. The Site is provided “as is” with respect to accessibility. We make no warranty, express or implied, that the Site is fully accessible to every user at all times or that it is free of technical barriers.

Automated accessibility scanners detect approximately 25 to 30 percent of WCAG conformance issues. Our accessibility efforts include both automated tooling and manual review processes. However, because content is regularly updated, added, or modified, temporary or partial non-conformance may occur. Occasional technical failures do not constitute intentional discrimination against individuals with disabilities.

Nothing in this policy creates any legal obligation beyond our good-faith commitment to ongoing improvement, and nothing in this policy shall be construed as a waiver of any limitation of liability or defense available to SDMP under applicable law.


7. FEEDBACK, COMPLAINTS, AND RESPONSE COMMITMENT

We welcome feedback from users who encounter accessibility barriers on the Site. Reporting an issue directly to us is the fastest path to resolution.

9. ONGOING REMEDIATION EFFORTS

Accessibility is not a one-time project. Our ongoing program includes the following activities:

– Periodic accessibility reviews of the Site, including following significant content updates, redesigns, or platform migrations
– Evaluation of new tools, plugins, themes, and third-party integrations for accessibility before deployment
– Remediation of barriers identified through user feedback, internal audits, or external review, prioritized by impact on usability
– Maintaining this policy as an accurate and current reflection of our accessibility status

We do not use automated accessibility overlay tools or widgets as a substitute for source-code remediation. Overlays have been demonstrated to conflict with native assistive technologies and have been the subject of adverse regulatory and judicial findings. Our approach to accessibility is based on structural improvements to the Site’s underlying code and content.


10. UPDATES TO THIS POLICY

We may update this Accessibility Policy from time to time to reflect changes in our practices, Site technology, or applicable standards. When we make material changes, we will update the “Last Updated” date at the top of this page. Continued use of the Site following an update constitutes acceptance of the revised policy.
